Terms of Sale

Version 2026-10-15 · effective 15 October 2026

These terms apply when you use pephive.com.au and when you buy from us. Our Privacy Policy, Shipping Policy and Refund and Returns Policy form part of these terms. Please read them together.

1. Who we are

This site is run by Pephive (ABN 34 414 282 275). In these terms, “we”, “us” and “our” mean Pephive. “You” means the person using the site or placing an order, and the organisation they represent.

Our full details are on our Contact page.

2. Research use only

  • All products are sold for research use only, for lawful laboratory research.
  • They have not been tested or approved for use in people or animals. They are not registered with any Australian regulator for that use.
  • They are not for human or veterinary use, diagnosis, treatment or consumption. They must not be used in food, cosmetics or diagnostic tests.
  • We do not sell them as medicines, therapeutic goods, foods, supplements or cosmetics.
  • Only trained people, or people working under their direct supervision, may handle them, and only in a suitable laboratory.
  • You are responsible for making sure that buying, holding and using the products is lawful where you are. This includes Commonwealth, state and territory laws, any permit, licence or scheduling rules, and the rules of your organisation.
  • We do not give advice about using products outside the laboratory. We will not answer questions about personal use.
  • If we reasonably believe a product will be used outside these terms, we may refuse or cancel the order and close the account.

Product descriptions, lab reports and other documents on our site are for identification and research records only. They are not instructions or advice. Lab reports are published for tested batches.

3. Who can buy

To enter the site and to buy from us, you must:

  • be 18 years of age or older; and
  • represent a legitimate research organisation, and buy only for that organisation’s own lawful laboratory research.

You must not resell products, give them away or send them outside Australia unless we have agreed in writing first.

We do not check identity documents, and we do not verify the organisation you represent. We rely on the statements you make. We may ask for more information at any time, and we may refuse an order if you do not give it.

If you are under 18, you must leave the site.

4. Entry and accounts

You can order as a guest or with an account. If we start to require an account with a confirmed email to order, we will tell you before you check out.

  • Before you can browse, you must confirm the three statements on the entry page. You confirm them again at checkout for every order.
  • If you create an account, we email you a link to confirm your email address. Until it is confirmed, the account may be limited.
  • If you have ordered from us before with the same email, we may link your past orders to your account once your email is confirmed.
  • Sign-in links are sent to your email, so keep your email account secure. You are responsible for orders placed through your account, unless the order was caused by our error.
  • If you get an email about an account you did not create, use the “Not you? Lock this account” link in that email, or contact us and we will lock it.
  • We may lock, suspend or close an account if a statement you made is untrue, if the account is misused, or if the law or our payment processor requires it.

5. The statements you confirm

You confirm these three statements on our entry page, when you create an account, and at every checkout, including when you pay for an existing order. Each statement has its own box. The boxes are never ticked for you, and all three must be ticked to continue.

  1. “I am 18 years of age or older.”
  2. “I represent a legitimate research organisation.”
  3. “Research use only: I will use these products for lawful laboratory research, not for human or veterinary use, diagnosis, treatment or consumption.”

By placing an order, you promise that each of these statements is true, and that you are allowed to place orders for the organisation you represent. Every order is placed on that basis. If any statement is untrue, we may cancel your orders and close your account.

6. Records of your confirmations

Each time you confirm the statements, we record:

  • the date and time;
  • your IP address and browser type;
  • which boxes were ticked, and the exact wording shown;
  • the version of these terms in force;
  • your account and order, where there is one.

We keep these records for 7 years. We may show them to our payment processor, the card schemes or a government authority, to show that an order was placed under these terms. Our Privacy Policy explains more.

7. Prices and payment

  • Prices are in Australian dollars and include GST where it applies.
  • Card payments are processed by our payment processor. Card payments are processed in US dollars: your statement shows the US dollar amount and your bank’s conversion back to Australian dollars, which can differ from our price by a few cents. Some banks also charge an international transaction fee; that fee is set by your bank, not by us.
  • Card payments appear on your bank statement as “PEPTIDESS SHOP HO”.
  • For PayID or bank transfer, the payment details are shown at checkout and emailed to you. We hold the order until the payment reaches us. Unpaid orders may be cancelled after 24 hours.
  • Any discount for paying by PayID or bank transfer is shown at checkout before you place the order.

8. Orders, and when we may cancel

Our product pages and prices invite you to place an order. They are not an offer. When you place an order, you make an offer to buy. We accept it when we dispatch the products.

Before dispatch, we may refuse or cancel an order only for one of these reasons:

  • a statement you made is untrue, or we reasonably believe the products will be used or supplied against these terms;
  • a product in the order is out of stock;
  • the payment is declined, reversed or not received, or we reasonably suspect fraud;
  • the delivery address is outside Australia, or we reasonably believe the products cannot lawfully be sent there;
  • our payment processor or the law requires it;
  • you ask us to cancel it.

If an order was placed at an obvious error in a price or listing, we may also cancel it, even after we have sent you an order confirmation.

If we cancel an order you have paid for, we refund the full amount you paid.

9. Delivery, ownership and risk

  • Delivery is covered by our Shipping Policy. We deliver within Australia only.
  • Returns and refunds are covered by our Refund and Returns Policy.
  • The products become yours once we have received full payment for them.
  • Risk in the products passes to you when they are delivered to the address you gave us.

10. Product quality and storage

  • When we dispatch them, products match the specification on their product listing and, where one is published, their lab report.
  • After delivery, store products as their label says.
  • We cannot replace products that are harmed by how they are stored or handled after delivery, unless the Australian Consumer Law requires us to.

11. Your rights under the Australian Consumer Law, and our liability

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or changes those rights.

Subject to those rights, and as far as the law allows:

  • our total liability for an order is no more than the price you paid for that order;
  • where section 64A of the Australian Consumer Law applies, our liability for failing to meet a consumer guarantee is limited to one of these, at our choice: replacing the products, supplying equivalent products, or paying the cost of replacing or repairing them;
  • we are not liable for loss caused by using the products in a way these terms do not allow;
  • we are not liable for indirect or consequential loss.

12. Your responsibilities

  • Give us true and complete information.
  • Never supply products to anyone for human or veterinary use, or to anyone under 18.
  • Store, handle and dispose of products safely and lawfully.

You agree to cover our losses and costs, including claims by other people and action by a regulator, to the extent they arise because a statement you made to us was false, or because you used or supplied products against these terms.

13. Using our website

  • Use the site lawfully. Do not interfere with its security, try to get around the 18+ step or the account checks, or copy or scrape its content.
  • The site’s content, photos and branding belong to us or our licensors. Do not copy them without our written permission.
  • We aim to keep the site accurate and available, but it may sometimes contain errors or be unavailable.

14. Events outside our control

We are not responsible for a delay or failure caused by events outside our reasonable control. If one affects your order, we will tell you and do what we reasonably can to limit the delay.

15. Changes to these terms

These terms have a version and an effective date, shown at the top of this page. We may change them. A new version applies to orders placed on or after its effective date, not to orders already placed. Because you confirm the statements at every checkout, each order records the version that applied.

16. General

  • These terms, with the policies linked at the top of this page, are the whole agreement between you and us about your orders. If a linked policy conflicts with these terms, these terms apply.
  • If we do not enforce a term straight away, we can still enforce it later. A waiver only counts if we give it in writing.
  • If any part of these terms cannot be enforced, the rest still applies.
  • These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales.
